Indictments: Accused arsonist indicted on murder charge

CHARLESTON, W.Va. -- An Alum Creek man accused of setting a fire that ultimately led to a Davis Creek firefighter's death was among 153 people indicted Friday by a Grand Jury. 

The indictment handed down against Charles Darren Roberts, 37, of Brounland Road charges him with third-degree arson, fourth-degree arson and first-degree murder in the death of Davis Creek-Ruthdale volunteer firefighter Joey King.

King, 61, and another firefighter responded Dec. 4 to a fire involving railroad ties north of Sproul Road near Alum Creek. They went to the Steven Wayne Smith Memorial Bridge on Corridor G to use it as a lookout point to try to spot the source.

Heavy smoke and fog limited visibility that night. No one saw King fall from the bridge. Firefighters later found his body on the embankment below the bridge.

The fire was located and extinguished.

Detectives with the Kanawha Bureau of Investigation worked with investigators with the state Fire Marshal's Office to determine the cause of the fire.

Detectives named Roberts as a suspect and questioned him, authorities said. He told investigators he used a cardboard box to ignite a tire, which then caused the railroad ties to catch fire, according to a statement from the Kanawha Sheriff's Office in December.

Roberts initially was charged with third-degree arson.

He remains at South Central Regional Jail on a $200,000 bond. 

Roberts is set to answer the indictment at 1 p.m. April 11 before Kanawha Circuit Judge Tod Kaufman.

Maurice White, a Fayette County teacher accused of having a sexual relationship with a student, also was among those indicted.

White, 61, of Rand was arrested in September after the parents of a 14-year-old girl reported the teen was involved in a romantic relationship with her teacher.

White had been the girl's teacher at Gauley Elementary School and was a substitute teacher at Valley High School, where she attended school at the time of the incident, according to a criminal complaint filed in Kanawha County.

The girl told investigators that White took her to his home and touched her sexually.

Police also found an assortment of photos featuring underage children in sexual positions in White's possession.

He remains at South Central Regional Jail, where he is being held without bond.

The indictment charges him with possession of material depicting a minor engaged in sexually explicit conduct, first-degree sexual abuse and sexual abuse by a parent, guardian, custodian or person of trust.

White is set to answer the indictment at 1:30 p.m. April 26 before Kanawha Circuit Judge Charles King.

An indictment is not a finding of guilt. All who are accused are presumed innocent until proven guilty.
