CHARLESTON, W.Va. -- A bus struck and killed a South Charleston man on Charleston's West Side early Thursday morning.
Joseph Bias, 40, was struck by a Kanawha Valley Regional Transportation Authority bus near the intersection of 4th Avenue and Stockton Street about 5 a.m., Charleston Police Sgt. Nick Null said.
Bias died at the scene.
The bus driver was found to be at fault but will not be charged, Null said.
"It was dark and the bus driver didn't see him," he said.
Bias had stepped onto the road at the intersection, he said.
"State code says that once a pedestrian has established their right of way, then vehicles have to yield to them," he said.
"But as far as criminal charges, we won't file any. It's just a horrific, horrific accident."
