CHARLESTON, W.Va. -- A Nicholas County man faces a felony incest charge for having sex with his adult stepdaughter, deputies said.
Nicholas Sgt. W.K. Shafer went to the Mt. Nebo area home of Kelcey Nicholas, 28, on Wednesday to arrest him for violating his home confinement, but noticed "inappropriate conduct" between Nicholas and his 21-year-old stepdaughter, Lataura Jarrett, according to a statement by the Nicholas Sheriff's Department.
Nicholas has been married to Jarrett's mother for the last five years and is still married to her, deputies wrote. Jarrett told deputies she and Nicholas had sex at least seven times since July 15, the release said.
Nicholas was arrested and charged with felony incest.
State code defines incest as "when such person engages in sexual intercourse or sexual intrusion with his or her father, mother, brother, sister, daughter, son, grandfather, grandmother, grandson, granddaughter, nephew, niece, uncle or aunt." If convicted, he could face five to 15 years in prison and/or a $500-to-$5,000 fine.
The law identifies a daughter as a person's natural or adoptive daughter or the daughter of a person's husband or wife. Father, in turn, is identified as a person's natural or adoptive father or the husband of his or her mother.
Nicholas remains at Central Regional Jail on $35,000 bond.
Deputies still are investigating. Jarrett does not appear to have been charged in the matter.
