A man accused of sexually assaulting a 17-year-old babysitter in 2011 pleaded guilty in Kanawha Circuit Court Monday to lesser charges.
Mark Anthony Terry, 40, of South Charleston was indicted by a grand jury on two counts of sexual assault, a felony. He entered into an agreement with prosecutors and will be sentenced on two counts of battery, which are misdemeanors.
Terry could be sentenced to up to a year in jail on each count.
In his plea hearing before Kanawha Circuit Judge Tod Kaufman, Terry said the girl exposed her breasts to him and he touched them.
In the criminal complaint filed by police in the case, authorities said the victim alleged Terry was taking her home about 3 a.m. after babysitting his children when he drove to an area near Montrose Elementary School and assaulted her.
He was arrested the next day.
Assistant Prosecutor Adam Campbell told the judge the plea agreement preserves the state's right to argue that the batteries were sexually motivated.
Terry will be sentenced next month.
