MARTINSBURG, W.Va. -- A Martinsburg man has been convicted on a weapons charge stemming from the shootings of another man and a child at a Fourth of July celebration.
A Berkeley County jury found 28-year-old Daniel L. Herbert guilty on Wednesday of being a felon in possession of a firearm. He's scheduled to be sentenced July 25.
Herbert faces a separate trial in September on other charges stemming from the shootings. The charges include attempted murder and malicious assault.
Police say Gabriel McGuire was shot twice in the back and an 8-year-old girl was shot in the leg during the 2012 event at War Memorial Park in Martinsburg. Their injuries weren't life-threatening.
